I always said that royalty free was the thin end of a big wedge…

There does seem to be a genuine problem with orphaned works that needs
addressing.

Right, but the cure is worse than the disease here. Somebody looked
at all the money that was made when the domain name registration
system was “privatized” and then went off to change their pants.

With no mention of a specific house bill or authoring representative in this article it is hard to see this as a real threat. The article is over the top on emotion, and sorely lacking in details, imho. Artists should be concerned that corporations want to usurp their creative rights… But until a bill is introduced or a representative starts shopping an amendment there is no point in getting as excited as this article purports. Politics requires clear and determined thinking, not emotional knee-jerking. The latter is usually followed with solicitations.

Many cock-eyed ideas are proposed for law every year, very few ever make it to vote and fewer still pass into law. That said, I will keep an ear out for actual legislation that develops from this. :slight_smile:

I haven’t read the whole article yet, but if Ernie is right and no reference is made to any specific bills in the House or Senate, that makes it hard to start a movement. If you were to write your Rep, they would want to know the bill (HR xxxx) otherwise it’s probably difficult for them to correlate what your are contacting them about.

Hopefully if there is such a thing, more information can be shared so we can do something about it.

Very clear thinking Ernie. This is certainly an alarming thing to
contemplate, but it may be no more fact-based than the recent scare
in the UK about limits being placed on taking photos in public. That
was alarming in the extreme… but it wasn’t based in fact.

Having said that, if it turns out to be true I will certainly be
lobbying my congressman. (And yes, I do have one.)

This may be helpful - the US Copyright website has information on the discussion surrounding Orphan Works as it was asked to generate a report on the subject for Senate subcommittees considering a 2006 House Resolution (HR 5439) which has remained in committee since that time. http://www.copyright.gov/orphan/

The bill has no co-sponsors, and the last major action was May of 2006 where it was forwarded to House Judiciary for discussion. I can see no momentum behind it, but those interested can contact representatives sitting on the House Judiciary Committee (not the Senate Judiciary, thankfully!). I may even do so, though I don’t think the bill has any legs.
